Background Genetic databases are becoming increasingly common as a means of determining the relationship between lifestyle, environmental exposures and genetic diseases. These databases rely on large numbers of research subjects contributing their genetic material to successfully explore the genetic basis of disease. However, as all possible research questions that can be posed of the data are unknown, an unresolved ethical issue is the status of informed consent for future research uses of genetic material. Discussion In this paper, we discuss the (...) difficulties of an informed consent model for future ineffable uses of genetic data. We argue that variations on consent, such as presumed consent, blanket consent or constructed consent fail to meet the standards required by current informed consent doctrine and are distortions of the original concept. In this paper, we propose the concept of an authorization model whereby participants in genetic data banks are able to exercise a certain amount of control over future uses of genetic data. We argue this preserves the autonomy of individuals at the same time as allowing them to give permission and discretion to researchers for certain types of research. Summary The authorization model represents a step forward in the debate about informed consent in genetic databases. The move towards an authorization model would require changes in the regulatory and legislative environments. Additionally, empirical support of the utility and acceptability of authorization is required. (shrink)

Mrs. F, seventy‐five, was diagnosed with Alzheimer's. She and her spouse often discussed how to handle the progression of the disease. She was adamant about not coming to the point where she would be unable to recognize herself, her husband, or their son and daughter. The manner she chose was voluntarily stopping eating and drinking (VSED), and she chose a specific date on which to carry out her plan. She asked her husband to promise, should she ever waver and request (...) nutrition or hydration, to remind her of the reasons she had chosen for pursuing this path.Mrs. F's ability to function was beginning to wax and wane. Sometimes she was her old self, and sometimes she had no recollection of her past identity. After she voluntarily stopped eating and drinking, the couple's promise created a dilemma for her professional caregivers. She asked for food and drink. Her husband and family reminded her of the reasons she had chosen VSED: “Remember, you didn't want to live in a nursing home, and you didn't want us to be responsible for caring for you at home. You believe that stopping eating and drinking will allow you to die with dignity.” Although they also asked Mrs. F, “What do you want to do?” the family asked the professional caregivers to respect her original choice to stop eating and drinking. Mrs. F still evidenced decision‐making capacity but often did not recall having chosen VSED. She again requested food and drink, from family and the professional caregivers.Can VSED be carried out for a patient whose advanced dementia makes disciplined voluntary action difficult? (shrink)

In February 1997, the Committee on Bioethics of the American Academy of Pediatrics updated its position on religious exemptions to medical care. In its earlier statement, the committee noted that forty-four states have religious exemptions to the child abuse and neglect statutes, and they argued for the repeal of these exemptions. The committee did not indude in its statement a position on religious exemptions to childhood immunization requirements that exist in forty-eight states, although this issue was discussed in committee meetings. In its revised statement, the committee concluded that “The AAP does not support the stringent application of medical neglect laws when children do not receive recommended immunizations.” In this paper, we consider whether failure to immunize one's child is a form of medical neglect and, if so, whether states should repeal their religious exemptions to the immunization statutes. Many philosophers judge that typical agent-causal accounts of freedom improperly sacrifice the possibility of rational explanation of the action for the sake of securing control, while others judge that the reverse shortcoming plagues typical event causal accounts. (Of course, many philosophers make both these judgments.) After briefly rehearsing the reasons for these verdicts on the two traditional strategies, we undertake an extended examination of Randolph Clarke's recent attempt to meet the challenge by proposing an original, "integrated agent-causal" account of human (...) free action. Social prescriptions are one term commonly used to describe non-pharmaceutical approaches to healthcare and are gaining popularity in the community, with evidence highlighting psychological benefits of reduced anxiety, depression and improved mood and physiological benefits of reduced risk of cardiovascular disease and reduced hypertension. The relationship between human health benefits and planetary health benefits is also noted. There are, however, numerous barriers, such as duration and frequencies to participate in activities, access, suitability, volition and a range of unpredictable variables impeding (...) a comprehensive approach to their use on a wider scale. From a multidisciplinary perspective, this commentary incorporates a salutogenic and nature-based approach to health, we also provide a range of recommendations that can be undertaken at the patient level to assist in shifting the acknowledged systemic barriers currently occurring. These include using simple language to explain the purpose of health empowerment scripts, ensuing personal commitment to a minimum timeframe, enabling ease of access, co-designing a script program, providing ongoing motivational support and incorporating mindfulness to counter unexpected disruptions. Human cooperation is highly unusual. We live in large groups composed mostly of non-relatives. Evolutionists have proposed a number of explanations for this pattern, including cultural group selection and extensions of more general processes such as reciprocity, kin selection, and multi-level selection acting on genes. Evolutionary processes are consilient; they affect several different empirical domains, such as patterns of behavior and the proximal drivers of that behavior. In this target article, we sketch the evidence from five domains that bear on (...) the explanatory adequacy of cultural group selection and competing hypotheses to explain human cooperation. Does cultural transmission constitute an inheritance system that can evolve in a Darwinian fashion? Are the norms that underpin institutions among the cultural traits so transmitted? Do we observe sufficient variation at the level of groups of considerable size for group selection to be a plausible process? Do human groups compete, and do success and failure in competition depend upon cultural variation? Do we observe adaptations for cooperation in humans that most plausibly arose by cultural group selection? If the answer to one of these questions is “no,” then we must look to other hypotheses. We present evidence, including quantitative evidence, that the answer to all of the questions is “yes” and argue that we must take the cultural group selection hypothesis seriously. If culturally transmitted systems of rules (institutions) that limit individual deviance organize cooperation in human societies, then it is not clear that any extant alternative to cultural group selection can be a complete explanation. The supporters of Indeterminate Futurism Theory [IFT] suggest three different reasons for preferring their view over Growing Block Theory [GBT]. If compared to GBT, IFT offers a better account for the open future problem, our cognitive attitudes towards future contingents, and how open the future is. Michael Tze-Sung Longenecker disagrees with them, stating that the advantages suggested by IFT's supporters are not advantages at all and/or can be accommodated by GBT. This means that, if he is right, there is no (...) reason to prefer IFT over GBT. However, if we prove the feasibility of one of the supposed advantages of IFT, Longenecker should admit that the game between IFT and GBT could still be open. Here, we focus on our cognitive attitudes towards future, with the aim of showing that the explanation of such attitudes may be a string to IFT's bow, as Ross Cameron suggests. (shrink)

In this paper I critically examine the implications of the uncodifiability thesis for principlism as a pluralistic and non-absolute generalist ethical theory. In this regard, I begin with a brief overview of W.D. Ross’s ethical theory and his focus on general but defeasible prima facie principles before turning to 2) the revival of principlism in contemporary bioethics through the influential work of Tom Beauchamp and James Childress; 3) the widespread adoption of specification as a response to the indeterminacy of (...) abstract general principles and the limitations of balancing and deductive approaches; 4) the challenges raised to fully specified principlism by the uncodifiability thesis and 5) finally offer a defense of the uncodifiability thesis against various critiques that have been raised. This paper addresses religious epistemology in that it concerns the assessment of the credibility of certain claims arising out of religious experience. Developments this century have made the world’s rich religious heritage accessible to more people than ever. But the conflicting religious claims tend to undermine each religion’s central claim to be a vehicle for opening persons to ultimate reality. One attempt to overcome this problem is provided by "perennial philosophy," which claims that there is a kind of mystical experience (...) common to all religious traditions, an experience which is an immediate contact with an absolute principle. Perennialism has been attacked by "contextualists" such as Steven Katz who argue that particular mystical experiences are so tied to a particular tradition that there are no common mystical experiences across traditions. In turn, Robert Forman and the "decontextualists" have argued that a certain kind of mystical experience and process are found in diverse traditions, thereby supporting one of the key elements of perennialism. I review the contextualist-decontextualist debate and suggest a research project that would pursue the question of whether the common ground of the world’s mystical traditions could be expanded beyond what has been established by the decontextualists. The extension of this common ground would add credibility to the claims arising out of mystical experience. (shrink)

This work re-examines the divisive wisdom that Paul addresses in 1 Corinthians. Challenging the recent consensus that the Corinthians' wisdom was rooted primarily in the Greco-Roman rhetorical tradition, Timothy A. Brookins offers a revisionary thesis centered on discourse similarities between the perspective of the Corinthian 'wise' and the Stoic system of thought. Brookins argues that several members of the church, after hearing Paul's initial gospel message, construed that message in terms of Stoic philosophy and began promoting a kind of (...) 'Stoic-Christian' perspective that helped to precipitate divisions in the church. Being apprised of their views, Paul then exploited the 'Stoic' discourse of his opponents in order to sustain common discursive ground. In addition to providing a fresh synthesis of the data in 1 Corinthians, Brookins brings in cutting-edge research on the ancient economy as he explores questions related to philosophical education and social status within the church community. John Schellenberg argues that divine hiddenness is evidence against God’s existence. More precisely, according to Schellenberg’s well-known Hiddenness Argument, God’s existence entails that there would never be any nonresistant non-believers; however, there are some non-resistant non-believers; therefore, God does not exist. In this paper, we offer a Molinist response or solution to the Hiddenness Argument. First, we briefly explain Molinism, we then describe Schellenberg’s Hiddenness Argument, and, finally, we argue that Molinism undercuts the view that God would necessarily ensure there (...) will never be any nonresistant non-believers. This is a response to Val Plumwood's critique of Plato and an overview of the way in which Plato provides a viable environmental vision. This vision sees the realm of nature as rooted in the realm of logos, and human beings as sojourners who are nonetheless integral parts of nature and whose vocation is to act as mediators between the two realms thereby bringing nature into even greater participation in logos. To fulfill the human vocation, one must come to an (...) awareness of the logos by purging oneself of the sham values which permeate society and distort one's understanding of reality. (shrink)

This article considers a Quine-Dennett style of argument from the indeterminacy of intentional content against the reducibility of mental states to neurological states. The most compelling version of such an argument, I suggest, is one that exploits a semantic anti-realist notion of truth; this holds out the promise of a relatively sophisticated story about the respects in which mental state attributions may be true or false of physical systems, without those states themselves being physical states.

This companion is both an introduction to and a guide through Edith Stein's On the Problem of Empathy. The opening essays demonstrate the work's historical significance and its relevance for contemporary philosophical discussions, while the subsequent chapters provide a clear and detailed summary of each section of Empathy.

According to Roger Poole, theological interpreters of Søren Kierkegaard’s indirect communication privilege content over form, whereas deconstructive interpreters privilege form over content. Here, I offer a reading of Johannes Climacus’s Philosophical Fragments to illustrate how, in this case, the theology/deconstruction and form/content binaries both break down. The form of Fragments is as theological as it is deconstructive: Climacus’s kaleidoscopic quotation of scripture, and his parabolic tropes both attest to this. Similarly, the content of Fragments is as deconstructive as it is (...) theological: the deferral of names, the madness of the moment of decision, and Climacus’s use of contradiction all unsettle any naïve theology. Ultimately, I suggest, the reason that Fragments resists the form/content and theology/deconstruction binaries is because it is a text about the incarnation – a paradigmatic combination of form and content, and a paradoxical reality that bursts apart any division between theology and deconstruction. Cunha and Caldieraro (2009) investigated whether sunk-cost effects, which are well documented in hypothetical situations involving monetary investments, also occur in choice situations with purely behavioral investments. Their results suggest that decision makers indeed fall prey to behavioral sunk-cost effects under certain circumstances. I have been unable to replicate their pattern of results in three separate investigations. In these studies, I attempted to recover the effect using two other behavioral effort manipulations in addition to the manipulation used by Cunha and (...) Caldieraro. This failure to replicate the pattern of results calls into question the robustness of the initial findings. (shrink)

This article examines the concurrent validity of the Kinder, Lydenberg, Domini Research & Analytics corporate social performance measures. Because KLD changed its evaluation methods to richer approaches, a new look at the concurrent validity of the indicators is necessary. To do this new look, the authors examine the new “Binary” and “Continuous” versions of the KLD and compare them with previous versions of KLD. The results suggest that the continuous scores provide better measurement characteristics than do the binary version. The use of vague language in law has important implications for legal theory. Legal philosophers have occasionally grappled with those implications, but they have not come to grips with the characteristic phenomenon of vagueness: the sorites paradox. I discuss the paradox, and claim that it poses problems for some legal theorists (David Lyons, Hans Kelsen, and, especially, Ronald Dworkin). I propose that a good account of vagueness will have three consequences for legal theory: (i) Theories that deny that vagueness in (...) formulations of the law leads to discretion in adjudication (including Dworkin's) cannot accommodate “higher-order” vagueness, (ii) A legal theory should accept that the law is partly indeterminate when it can be stated in vague language, (iii) However, the traditional formulation of the indeterminacy claim, that a vague statement is “neither true nor false” in a borderline case, is misconceived and should be abandoned. We suggest that supergenes, groups of co‐inherited loci, may be involved in a range of intriguing genetic and evolutionary phenomena in insect societies, and may play broad roles in the evolution of cooperation and conflict. Supergenes are central in the evolution of an array of traits including self‐incompatibility, mimicry, and sex chromosomes. Recently, researchers identified a large supergene, described as a social chromosome, which controls social organization in the fire ant. This system was previously considered to be a remarkable example (...) of a single gene affecting a complex social trait. We describe how selection may commonly favor reduced recombination and the formation of supergenes for social traits, and once formed, supergenes may strongly influence further evolutionary dynamics within and between lineages. The evolution of supergenes, and even wholly non‐recombining genomes, may be particularly common in systems in which genetically distinct lineages can form mutually reinforcing socially parasitic relationships.
